Terms & Conditions

1. Agreement to Terms

By engaging Nuvira Perform for any creative services — including script development, digital project production, creative project management, media production consulting, or branded content creation — you agree to be bound by these Terms & Conditions.

2. Services

Nuvira Perform provides the following services:

Creative services and concept development
Script development and copywriting
Digital project production
Creative project management
Media production consulting
Branded content creation

The specific scope, deliverables, timeline, and fees for each project will be outlined in a separate project agreement or statement of work.

3. Payment Terms

Unless otherwise agreed in writing, a deposit of 50% of the total project fee is required before work commences. The remaining balance is due upon project completion and before final file delivery. Late payments may incur a fee of 1.5% per month.

4. Intellectual Property

All creative work produced by Nuvira Perform remains the intellectual property of Nuvira Perform until full payment is received. Upon receipt of full payment, ownership of the final deliverables transfers to the client, unless otherwise specified in the project agreement.

5. Revisions

Each project includes a defined number of revision rounds as specified in the project agreement. Additional revisions beyond the agreed scope will be billed at our standard hourly rate.

6. Confidentiality

Both parties agree to keep confidential any proprietary information shared during the course of the project. This obligation survives the termination of the project agreement.

7. Limitation of Liability

Nuvira Perform's total liability for any claim arising from our services shall not exceed the total fees paid by the client for the specific project giving rise to the claim.

8. Governing Law

These Terms & Conditions are governed by the laws of the State of Colorado, USA. Any disputes shall be resolved in the courts of Westminster, CO.

Legal · Refunds

Refund Policy

1. General Policy

Due to the custom and creative nature of the services provided by Nuvira Perform — including script development, digital production, branded content creation, and media consulting — all sales are generally considered final once work has commenced.

2. Deposits

Initial deposits are non-refundable. They cover the time invested in project scoping, research, creative strategy, and resource allocation prior to production beginning.

3. Cancellation Before Work Commences

If a project is cancelled in writing before any work has begun, the client may be eligible for a full refund of any payments made beyond the deposit. Cancellation requests must be submitted via email to team@nuviraperform.com.

4. Cancellation After Work Has Commenced

If a project is cancelled after work has commenced, the client will be invoiced for all work completed up to the date of cancellation, calculated at our standard hourly rate. Any overpayment beyond the value of work completed will be refunded within 14 business days.

5. Revisions and Dissatisfaction

We are committed to delivering work that meets the agreed brief. If you are dissatisfied with a deliverable, we encourage you to first utilise the revision rounds included in your project agreement. Refunds are not issued on the basis of subjective creative preference once the agreed revision rounds have been completed.

6. Exceptional Circumstances

In cases of significant failure to deliver agreed services due to circumstances within Nuvira Perform's control, we will work with the client in good faith to provide an appropriate remedy, which may include a partial or full refund at our discretion.

7. How to Request a Refund

All refund requests must be submitted in writing to team@nuviraperform.com with your project details and reason for the request. We will respond within 5 business days.
